What are the trademark renewal due dates in Benelux?
Benelux counts the 10-year term from the filing date. The renewal window opens six months before the expiry date and closes on it.
The first renewal falls due 10 years from the filing date, payable to BOIP. Renewal can be requested from six months before the expiry date, and not earlier.
For example, if the filing date is 2015-03-15, the renewal window opens on 2024-09-15 and the deadline is 2025-03-15.
Each renewal extends protection for a further 10 years, on the same window. Protection is renewable indefinitely, with no limit on the number of renewals.
For example, once renewed in 2025, the next renewal will be due by 2035-03-15.
In the Benelux, trademarks are renewed through the Benelux Office for Intellectual Property (BOIP), based in The Hague. A standard domestic trademark registration for Belgium, the Netherlands or Luxembourg is obtained through the unified Benelux system rather than through three separate national trademark offices.
If you need protection across the wider European Union, an EU trademark filed at the EUIPO is the alternative route. If your trademark is an International Registration designating the Benelux, the renewal of that international registration is handled through WIPO Madrid System procedures rather than directly through BOIP.

Missed a trademark renewal deadline in Benelux?
A six-month grace period runs from the expiry date, with a EUR 135 fee over and above the renewal fee. Once that period passes the trademark has expired and you have to apply for a new registration. Benelux has no restoration route.
If the renewal deadline of 15 Mar 2025 is missed, the mark stays renewable until 15 Sep 2025. Settle the renewal fee and the late fee inside that window to keep it in force.

1. When is the first trademark renewal filing due in the Benelux?
The first renewal is due at the end of the initial 10-year term, calculated from the filing date. You can file the renewal within the 6 months before the expiry date. A 6-month grace period after expiry is available with a EUR 135 surcharge. If the six-month post-expiry period is missed, the registration can no longer be maintained through the ordinary BOIP renewal procedure.
2. Can I renew my trademark after missing the deadline?
Yes, but only within the 6-month grace period after the expiry date, and only by paying a surcharge of EUR 135 on top of the renewal fee. Once that period has passed, renewal is no longer possible.
3. How long does a Benelux trademark last?
A Benelux trademark registration lasts 10 years from the filing date, and each renewal extends it for another 10 years. There is no limit to the number of times a trademark can be renewed, as long as renewal fees are paid on time.
4. Does BOIP require proof of use for renewal?
BOIP does not require proof of use as part of the renewal filing. However, a registration may become vulnerable to cancellation on grounds of non-use under Benelux trademark law.
5. Can I renew a trademark for only the Netherlands, Belgium or Luxembourg?
No. The Benelux operates as a single trademark territory. One registration covers all three countries and one renewal maintains protection in all three. There is no way to split the registration by country or to renew for only part of the territory. You can, however, renew only some of the classes covered by the registration.
