In the Benelux, trademarks are renewed through the Benelux Office for Intellectual Property (BOIP), based in The Hague. A standard domestic trademark registration for Belgium, the Netherlands or Luxembourg is obtained through the unified Benelux system rather than through three separate national trademark offices.
If you need protection across the wider European Union, an EU trademark filed at the EUIPO is the alternative route. If your trademark is an International Registration designating the Benelux, the renewal of that international registration is handled through WIPO Madrid System procedures rather than directly through BOIP.
Trademark protection in the Benelux is granted for a fixed term starting from the filing date, and each renewal extends protection for another term. Under current rules, the term is 10 years.
Renewal is filed within the 6 months before the expiry date. The Benelux also allows a late renewal period of up to 6 months after expiry, subject to a surcharge. Once that 6-month period has passed, renewal is no longer possible and a new trademark application is required.
For example, if the filing date of a Benelux trademark is 2015-11-10:
The initial term ends on 2025-11-10 (10 years).
The renewal window opens on 2025-05-10 (6 months before expiry) and closes on 2025-11-10.
The grace period then runs from 2025-11-11 to 2026-05-10, with a surcharge of EUR 135 payable.
Once renewed, the next renewal would be due by 2035-11-10, and so on.

The first renewal is due at the end of the initial 10-year term, calculated from the filing date. You can file the renewal within the 6 months before the expiry date. A 6-month grace period after expiry is available with a EUR 135 surcharge. If the six-month post-expiry period is missed, the registration can no longer be maintained through the ordinary BOIP renewal procedure.
