Design renewal fees in Kazakhstan: costs, due dates and grace period
A registered design in Kazakhstan lasts up to 25 years from the filing date. An annual maintenance fee is due every year, and the term is extended after year 10 and then every 5 years. Miss a payment and you have 6 months to put it right, with a 50% surcharge.
What are the design renewal due dates in Kazakhstan?
Kazakhstan protects a registered design for up to 25 years from the filing date. An annual fee falls due every year, and the term is extended 3 times, after years 10, 15 and 20.
The first term extension falls due before the end of year 10, payable to NIIP. It carries the design into year 11.
For example, if the filing date is 2015-03-15, the first term extension is due by 2025-03-15.
Each further extension runs every 5 years on the same basis, until the 25-year maximum is reached, with the annual fee due every year throughout.
For example, protection can be kept alive until 2040-03-15, after which no further renewal is possible.
Kazakhstan is not a member of the Hague System. There is no international design route into Kazakhstan: a design must be registered directly with NIIP, and every renewal fee is paid to NIIP rather than to WIPO.
A design registered here can be kept alive for at most 25 years. An annual fee is due every year; on top of that the term is first extended by 15 Mar 2025 and then every 5 years, 3 extensions in total. Miss a payment and you have 6 months to put it right with a 50% surcharge, until 15 Sep 2025 in this example.

Missed a design renewal deadline in Kazakhstan?
A six-month grace period runs from each due date. You can still pay inside it, with a surcharge of 50% of the fee. On top of the annual fees, the term must be extended after year 10 and then every 5 years. NIIP sets its fees in KZT and revises them by order, so check the current amount before you pay.
If the extension due on 15 Mar 2025 is missed, the design stays recoverable for 6 months, until about 15 Sep 2025 in this example.

What happens to a Kazakh industrial design before it has been registered?
There are no annuities due in Kazakhstan before the patent is granted. Once the patent has been granted, annuities must be paid in accordance with the renewal interval described above under the section Due Dates.
When can I pay the renewal fee in Kazakhstan?
The renewal fee in Kazakhstan can be paid up to 12 months before the renewal due date. It is important to note that the renewal fee cannot be paid earlier than this. Any payments made before the opening of the payment window will result in the payment being rejected.
Can I renew an industrial design after I miss a renewal due date?
Yes, it is possible to renew a Kazakh industrial design after its renewal due date. If you fail to pay the renewal fee before the due date, a grace period of 6 months is given wherein the renewal fees can still be settled. When entering the grace period you will incur a surcharge fee to be settled along with the renewal fee. If you wish to maintain the industrial design, both the renewal fee and the surcharge fee will have to be settled. For example, if an industrial design has a renewal due date of 2021-05-31 and the due date is missed, the industrial design will enter the grace period from 2021-06-01. After this point both the renewal fee and the surcharge fee will need to be settled by 2021-11-30. Failure to pay these fees before the surcharge due date will result in the industrial design lapsing.
How long do industrial designs last in Kazakhstan?
