A registered design in Ukraine lasts up to 25 years from the filing date. An annual fee is due every year, and every 5 years the term must also be extended on request. Miss an annual fee and you have 6 months to put it right, at 150% of the normal fee.
What are the design renewal due dates in Ukraine?
Ukraine protects a registered design for up to 25 years from the filing date. An annual fee falls due every year, and the term is extended every 5 years, 4 times in all.
The first annual fee after registration falls due before the end of year 1, payable to UKRNOIVI. It carries the design into year 2.
For example, if the filing date is 2015-03-15, the first annual fee after registration is due by 2016-03-15.
An annual fee falls due every year on the same basis, until the 25-year maximum is reached. The term itself must be extended every 5 years, no later than 6 months before it ends.
For example, protection can be kept alive until 2040-03-15, after which no further renewal is possible.
Ukraine is a member of the Hague System. A design registered nationally is renewed by paying UKRNOIVI. Where protection instead comes from an international registration designating Ukraine, the renewal is paid directly to WIPO's International Bureau. WIPO registers designs and does not grant them, so UKRNOIVI remains free to refuse protection under its own law.
A design registered here can be kept alive for at most 25 years. The first annual fee after registration falls due on 15 Mar 2016, and annual fees then run every year, 24 in total; the term must also be extended every 5 years. Miss an annual fee and you have 6 months to put it right at 150% of the fee, until 15 Sep 2016 in this example.

The year 1 fee is paid at registration. Each five-year term must also be extended on request, no later than 6 months before it ends.
The renewal fees for industrial designs in Ukraine vary depending on whether the industrial design is a national registration or an international registration through the WIPO. For international registrations, fees also depend on the number of industrial designs in the application and whether it is a family registration. For national registrations, fees also vary depending on whether the applicant qualifies for reduced fees (e.g., individual inventors or small entities).

Missed a design renewal deadline in Ukraine?
A six-month grace period runs from the due date of each annual fee. You can still pay inside it, at 150% of the normal fee. The five-year term must also be extended on request, with a UAH 800 fee, no later than 6 months before it ends. Designs filed before 16 August 2020 were granted for 10 years with a possible 5-year extension, so check their schedule with the office. Once the grace period closes, the design lapses.
If the annual fee due on 15 Mar 2016 is missed, the design stays recoverable for 6 months, until about 15 Sep 2016 in this example.

What happens to an Ukrainian industrial design before it has been registered?
There are no annuities due in Ukraine before the patent is granted. Once the patent has been granted, annuities must be paid in accordance with the renewal interval described above under the section Due Dates.
When can I pay the renewal fee in Ukraine?
The renewal fee in Ukraine can be paid up to 6 months before the renewal due date. It is important to note that the renewal fee cannot be paid earlier than this. Any payments made before the opening of the payment window will result in the payment being rejected.
Can I renew an industrial design after I miss a renewal due date?
Yes, it is possible to renew an Ukrainian industrial design after its renewal due date. If you fail to pay the renewal fee before the due date, a grace period of 6 months is given wherein the renewal fees can still be settled. When entering the grace period you will incur a surcharge fee to be settled along with the renewal fee. If you wish to maintain the industrial design, both the renewal fee and the surcharge fee will have to be settled. For example, if an industrial design has a renewal due date of 2021-05-31 and the due date is missed, the industrial design will enter the grace period from 2021-06-01. After this point both the renewal fee and the surcharge fee will need to be settled by 2021-11-30. Failure to pay these fees before the surcharge due date will result in the industrial design lapsing.
